8. Refunds

a. We are not required to provide a refund or replacement of a Product or Service or reimbursement for any shipping if You change Your mind. b. You can choose a refund or exchange if You receive an incorrect Product or Service or a Product or Service has a ‘major problem’. A major problem includes:

iii. the Product is significantly different from the sample or description; or

iv. the Product or Service fails to do what We said it would, or what You asked for and cannot be easily fixed.

c. If Your Product has a major problem, please email Us within 24 hours of identifying the major problem and include a description of the major problem, a copy of Your receipt and photos of the major problem.

d. Please note that if the problem is not major, We may elect repair the item rather than provide a refund or offer an exchange.

To the fullest extent allowable under applicable law, the maximum aggregate liability of Us or other affiliated companies to a User, whether in contract, tort (including negligence), strict liability or other theory, arising out of or relating to the use of or inability to use the Website or the Products and Services, is the amount that the User pays, if any, to Us for access to or use of the Website or the Products and Services during the six months period immediately prior to the event giving rise to such liability or one hundred dollars (AUD$100) if no such payments have been made, as applicable.

a. We rely on the services of third party service providers to conduct Our business. Our core service providers include (without limitation) IT service providers, data storage, web-hosting and server providers, debt collectors, data analytics providers, maintenance or problem-solving providers, marketing or advertising providers, professional advisors and payment systems operators including but not limited to:

i. Ignition;

ii. Stripe;

iii. Ontraport;

iv. Google Analytics; and

v. Calendly.

b. By using the Website, You acknowledge that You have read and accepted:

c. If any of the provisions of the Ignition Terms, Stripe Terms, Ontraport Terms, Google Terms or Calendly Terms conflict with the Terms of Service, the terms of the Terms of Service have priority.

a. Headings used in these Terms of Service are included for convenience only and will not limit or otherwise affect their meaning.

b. The failure of Us to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision.

c. Any ambiguities in the interpretation of the Terms of Service shall not be construed against the drafting party.

d. These Terms of Service, the Website and the Products and Services are governed by the laws of New South Wales, Australia. Each party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts operating in New South Wales, Australia.

e. If any provision of these Terms of Service shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Service and shall not affect the validity and enforceability of any remaining provisions, which continue in full force and effect.

f. You agree to use Your best endeavours to resolve any dispute arising out of or relating to these Terms, with Us, prior to resorting to any external dispute resolution process. Please notify Us in writing of any dispute You may have.

g. In respect of the subject matter of the Terms of Service, the Terms of Service contain the entire understanding between the Parties. Any previous oral and written communications, representations, warranties or commitments are superseded by the Terms of Service and do not affect the interpretation or meaning of the Terms of Service and each of the parties has relied entirely on its own enquiries before entering into the Terms of Service.
